These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, govern sales made through the Goblin's WAY online store, accessible at shop.jbmonge.com.
They apply to all orders placed with Goblin's WAY by a customer, hereinafter referred to as the “Customer”, and define the rights and obligations of the parties in connection with the sale of products offered through the online store.
By placing an order, the Customer unconditionally accepts these Terms and Conditions of Sale.

2. Products
Goblin's WAY offers for sale, in particular, books, Fine Art Prints, posters, postcards, bookmarks and other creations related to the artistic universe of Jean-Baptiste Monge.
The essential characteristics of each product are presented on its product page. Customers are invited to review this information before placing an order.
The photographs and reproductions displayed on the online store are intended to represent the products as accurately as possible. Minor differences in appearance, particularly in colour, may nevertheless occur depending on the screen and its settings.
Products are offered subject to availability or, where expressly indicated on the product page, according to the production conditions specified for the product concerned.

3. Prices
The applicable prices are those displayed on the online store at the time the order is placed.
Prices are shown in the currency displayed on the online store and include, where applicable, taxes due on the sale.
Any shipping costs are shown separately before final confirmation of the order.
For deliveries to certain countries or territories outside the European Union, customs duties, import taxes or other charges may be imposed by local authorities. Unless otherwise stated, these charges are not collected by Goblin's WAY and remain the responsibility of the recipient.
4. Orders
The Customer selects the products they wish to purchase and adds them to their shopping cart.
Before final confirmation of the order, the Customer can review the contents of the cart, the total price and the information provided, and correct any errors.
The order becomes final once it has been confirmed by the Customer, these Terms and Conditions of Sale have been accepted, and payment has been confirmed according to the selected payment method.
An order confirmation is sent to the email address provided by the Customer when placing the order.
Goblin's WAY reserves the right to refuse or cancel an order in the event of proven fraud, a previous payment dispute or a clear inability to fulfil the order, subject to applicable legal provisions.
5. Payment
The payment methods currently available on the online store are Stripe and PayPal.
Payments are processed through the secure services of the relevant payment providers. Goblin's WAY does not retain the complete banking details used to make the payment.

6. Preparation and shipping
Orders are prepared at our Studio in France.
The usual preparation time before dispatch is 2 to 5 business days, unless otherwise stated on a product page or in exceptional circumstances.
Available shipping methods depend in particular on the destination, weight, dimensions and nature of the order.
Transit times displayed or communicated are estimates when they depend on the carrier, without prejudice to the consumer's statutory rights concerning delivery.

7. Receipt and delivery issues
The Customer is advised to check the condition of the parcel and products upon receipt.
If a product is damaged, an item is missing or there is any other issue with the order, the Customer is invited to contact Goblin's WAY as soon as possible, quoting the order number and, where useful, providing photographs showing the issue.
This procedure does not affect any statutory rights or guarantees available to the Customer.
8. Right of withdrawal
In accordance with the French Consumer Code, where the right of withdrawal applies, the consumer has a period of fourteen days from receipt of the goods in which to exercise this right without having to provide a reason.
Where several goods from the same order are delivered separately, the withdrawal period runs from receipt of the last relevant item, lot or piece.
To exercise the right of withdrawal, the Customer must notify Goblin's WAY of their decision to withdraw by means of an unambiguous statement or by using the model withdrawal form provided at the end of these Terms.
After notifying Goblin's WAY of their decision, the Customer must return the relevant products within the statutory period.
The direct cost of returning the products is borne by the Customer, except where otherwise provided by law or where the return results from an error attributable to Goblin's WAY.
Products must be returned in a condition allowing them to be resold. The Customer may be held liable for any diminished value of the goods resulting from handling other than that necessary to establish their nature, characteristics and proper functioning.
Refunds are made within the time limits and according to the procedures prescribed by applicable law, using the same means of payment as that used for the original transaction, unless expressly agreed otherwise.
9. Exceptions to the right of withdrawal
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised.
The presence of the artist's simple signature, where this is a standard option offered on the online store, does not in itself exclude the right of withdrawal.
However, a product that has been specifically personalised at the Customer's request, such as with a named dedication, personal message or any other inscription made specifically for that Customer, is not eligible for the right of withdrawal under the conditions provided by law.
Where this exception applies, the Customer is informed before the order is concluded.
10. Statutory guarantees
Products sold by Goblin's WAY are covered by the statutory guarantees provided by applicable law, including the French statutory guarantee of conformity provided for by the French Consumer Code and the guarantee against hidden defects provided for by the French Civil Code.
These statutory guarantees apply independently of any commercial guarantee that may be offered.
If a product may be covered by one of these guarantees, the Customer may contact Goblin's WAY using the contact details provided in these Terms.
11. Intellectual property
The works, illustrations, texts, photographs, graphics, logos and other content presented on the online store are protected by applicable intellectual property laws.
The purchase of a product, including a book, Fine Art Print, poster or any other medium reproducing a work, does not transfer any intellectual property rights attached to that work.
Unless prior written permission has been obtained from the rights holder, any unauthorised reproduction, adaptation, distribution, commercial exploitation or other unauthorised use is prohibited within the limits provided by law.

This prohibition applies in particular to any use of the works or reproductions thereof for the training, development or input of generative artificial intelligence systems without the rights holder's prior express authorisation, subject to applicable law.
12. Personal data
Personal data required to process orders and manage the relationship with the Customer is processed in accordance with applicable regulations.
Information concerning the data collected, the purposes for which it is processed, its retention and the rights of data subjects is detailed in the online store's Privacy Policy.
13. Liability
Goblin's WAY is responsible for the proper performance of its obligations under the contract in accordance with applicable law.
However, Goblin's WAY shall not be held liable where failure to perform or improper performance of the contract is attributable to the Customer, to the unforeseeable and unavoidable act of a third party to the contract, or to an event of force majeure, under the conditions provided by law.

15. Applicable law
These Terms and Conditions of Sale are governed by French law.
Where the Customer is a consumer residing in another country, this provision shall not deprive the Customer of any mandatory consumer protection provisions afforded to them under the law applicable in their country of residence, where such provisions apply.
16. Amendments to these Terms
Goblin's WAY may amend these Terms and Conditions of Sale, in particular to reflect changes in its activities, the online store or applicable regulations.
The Terms applicable to an order are those accepted by the Customer at the time the order is placed.
